Where we rely on legitimate interests, those interests are responding to professional enquiries, operating and improving our websites and services, maintaining appropriate business records, and protecting the websites and business from misuse. If you sign up to receive updates, downloads or resources, we may use your email address to send relevant communications. Where an enquiry form marks a field as required, we need that information to assess and respond to the enquiry or to take steps before entering into a contract. You are not under a statutory obligation to provide it, but we may be unable to assess the enquiry or provide the requested service without it. We do not use information collected through these websites to make solely automated decisions about individuals or to carry out profiling.

3. TERMS

Website Terms & Digital Product Terms of Sale

3.1 About these terms

These terms apply when you use our websites, access free resources, purchase digital products, download materials, join a mailing list, submit an enquiry or use related resources. By using the websites or purchasing/downloading products, you agree to use the materials responsibly, lawfully and in line with these terms.

3.2 Digital products and resources

Digital products may include PDFs, toolkits, templates, briefings, leadership resources, self-evaluation tools, planning documents or other downloadable materials. Product descriptions are provided in good faith. We may update products, descriptions, files, pricing or availability from time to time.

3.3 Licence to use purchased or downloaded materials

Unless a separate written licence says otherwise, purchasing or downloading a product gives you a non-exclusive, non-transferable licence to use that product for internal professional purposes within your own school, trust, organisation, business or professional context.

You may adapt templates for your own internal professional use. You must not resell, redistribute, upload publicly, share externally, copy into another commercial product, remove copyright notices, claim authorship, or use the materials to create a competing product.

3.4 Intellectual property

All content, including frameworks, wording, templates, resources, product names, structure, design, methods and downloadable materials, is owned by or licensed to The Excellence Classroom / Beyond Readiness Tools. Nothing in these terms transfers ownership of intellectual property rights to you.

3.5 Payments and checkout

Payments may be processed through third-party checkout or payment providers. We do not usually collect or store full payment card details directly. Prices may change from time to time.

3.6 Access and delivery

Digital products are usually delivered by immediate download, email link, checkout account access or another digital delivery method. If you experience access problems, contact hello@theexcellenceclassroom.com.

3.7 Updates

Some resources may be updated to reflect changes in guidance, inspection expectations or practice. Unless clearly stated otherwise, purchase of a digital product does not guarantee indefinite free updates.

3.8 Professional service enquiries and bookings

Submitting an enquiry does not create a booking or contract. Scope, deliverables, fee, timing, participants and any document review will be confirmed in writing before payment and booking.

3.9 Payment

Unless agreed otherwise in writing, full payment is required before a professional service booking is confirmed. Payment may be made by card or invoice. An invoice booking is not secured until payment has been received.

3.10 Online and in-person delivery

Reviews and planning intensives are delivered online as standard. In-person delivery may be agreed separately. Travel time, travel expenses and any additional venue or delivery costs will be confirmed before booking.

3.11 Documents and confidentiality

Do not send confidential, sensitive or pupil-identifiable information until requested and appropriate arrangements have been agreed. Clients are responsible for ensuring they have authority and a lawful basis to share any information supplied.

3.12 Rescheduling and cancellation

Unless different terms are agreed in writing, at least three working days’ notice is required to reschedule or cancel a professional service booking. Where less notice is given, the fee is normally non-refundable, but one reschedule may be offered by agreement and subject to availability.

3.13 Statutory rights

Nothing in these terms removes or limits any statutory rights that apply. Where consumer cancellation rights or other mandatory legal requirements apply, the booking confirmation will explain them and take precedence over any inconsistent general wording on this page.

4. REFUNDS

Refund & Cancellation Policy

4.1 Digital downloads

Digital products may be made available for immediate access or download after purchase. Where you choose immediate access and acknowledge at checkout that cancellation rights may be lost once download/access begins, you may lose the right to cancel once the digital content has been supplied.

4.2 When refunds may be considered

Refunds are not normally offered after download or access unless required by law. We will consider refund requests where:

  • A duplicate purchase has been made in error
  • The wrong product was supplied
  • There is a significant technical access issue that cannot reasonably be resolved
  • The product is materially not as described
  • A refund is otherwise required by consumer law

Contact hello@theexcellenceclassroom.com with your name, order email, product purchased, purchase date and a brief explanation. Please do this as soon as possible so we can investigate and respond fairly.

4.4 Statutory rights

Nothing in this policy affects any statutory rights you may have under applicable consumer law.

5.1 Nature of the resources

The Excellence Classroom and Beyond Readiness Tools provide professional development, leadership reflection, school improvement, assurance, implementation and self-evaluation resources. They are designed to support professional thinking and decision-making.

5.2 Not a substitute for professional or legal advice

The resources are not legal advice, HR advice, financial advice, medical advice, safeguarding case advice, inspection advice from an inspectorate, or a replacement for statutory guidance, local authority processes, professional judgement or specialist advice. Schools, trusts and professionals remain responsible for checking current statutory guidance relevant to their own context.

5.3 Safeguarding and urgent concerns

If a safeguarding concern, child protection concern, immediate risk or emergency arises, users must follow their own safeguarding policy, local safeguarding procedures, statutory guidance and emergency processes. These resources must not delay urgent action.

Use of any resource, template, toolkit, briefing or assurance process does not guarantee a particular inspection outcome, regulatory judgement, school improvement result, funding result or professional decision.

5.5 User responsibility

Users are responsible for applying resources appropriately, adapting them to context, checking accuracy, maintaining confidentiality, avoiding unnecessary personal data, and ensuring that any completed tools or records are stored and used securely.
